Damage or Injury Claim

Under the Ohio Revised Code, only the Ohio Court of Claims may determine whether Shawnee State University is liable for a claim (other than motor vehicle claims) alleging property damage or personal injury as a result of action, or failure to act, by the university or its employees.

Civil actions against the university for $10,000 or less are determined administratively by the clerk of the court.  Any such claim must be filed on the complaint form provided by the court.  Claims for amounts greater than $10,000 are determined by a judge of the court.  The form and procedure for complaints are governed by the Ohio Rules of Civil Procedure and by the Local Rules of the Court of Claims of Ohio.

The Ohio Revised Code requires that if a plaintiff receives, or is entitled to receive, any benefits to cover the alleged injuries or loss (from an insurance policy or any other source), those benefits must be disclosed to the court, and the amount of the benefits will be deducted from any award against Shawnee State University recovered by the plaintiff.
